These Terms and Conditions govern the use of the MZ Fashion Designers online store and the purchase of products from MZ Fashion Designers.

By accessing our website, placing an order, or purchasing products from us, you agree to be bound by these Terms and Conditions, together with our Privacy Policy and any other policies displayed on our website.

These Terms and Conditions are governed by the laws of the Republic of South Africa.

2. Acceptance of Orders

When you place an order through our online store, you are making an offer to purchase the selected products.

An order is subject to product availability and successful payment.

We reserve the right to decline or cancel an order where:

  • the product is unavailable;
  • there has been an obvious pricing or product-description error;
  • payment has not been successfully received;
  • we reasonably suspect fraudulent or unauthorised activity; or
  • circumstances beyond our reasonable control prevent us from fulfilling the order.

If we cancel an order after payment has been received, we will refund the amount paid, subject to any rights and remedies available to the consumer under applicable South African law.

3. Product Information

We make reasonable efforts to ensure that product descriptions, photographs, colours, sizes and prices displayed on our website are accurate.

However, colours may appear differently depending on your device or screen settings.

Minor variations in colour, texture, pattern, measurements or appearance may occur, particularly with handmade, customised or individually manufactured garments.

Nothing in these Terms and Conditions limits any rights that you may have under applicable South African consumer law.

4. Prices

All prices displayed on our website are in South African Rand (ZAR) unless otherwise stated.

The price payable for an order will be the price displayed at the time the order is placed, subject to any obvious error.

Delivery charges, where applicable, will be displayed before you complete your purchase.

MZ Fashion Designers reserves the right to change product prices at any time. A price change will not affect an order that has already been accepted and paid for, except where permitted by law.

5. Payment

Payment must be made using the payment methods made available through our online store.

An order will generally only be processed once payment has been successfully received or authorised.

Customers must ensure that payment information supplied to us is accurate and that they are authorised to use the selected payment method.

We do not store complete bank-card details where payment is processed through a third-party payment provider, except to the extent permitted by applicable law and the provider's terms.

6. Delivery

We deliver to addresses within South Africa and, where offered, to selected international destinations.

Delivery charges and estimated delivery times will be communicated during the ordering process.

Delivery times are estimates and may be affected by circumstances outside our reasonable control, including courier delays, public holidays, adverse weather, strikes, incorrect delivery information or other unforeseen events.

Customers are responsible for providing a complete and accurate delivery address and contact details.

Where required by applicable law, the risk associated with goods remains with MZ Fashion Designers until the goods are delivered to the consumer or otherwise accepted in accordance with the law.

7. Custom-Made and Personalised Clothing

Where MZ Fashion Designers offers custom-made, made-to-measure or personalised clothing, the customer is responsible for providing accurate measurements, specifications, colours and other information requested from them.

Because customised garments may be made specifically according to a customer's specifications, the applicable cancellation, return and refund rights may differ from those applicable to standard products, to the extent permitted by South African law.

We will nevertheless honour any consumer rights that cannot lawfully be excluded or restricted.

8. Returns, Exchanges and Refunds

We want our customers to be satisfied with their purchases.

Any return or exchange must comply with our applicable return procedure. Unless otherwise required by law, returned clothing should be:

  • unworn;
  • unwashed;
  • undamaged;
  • free from stains, makeup, perfume or other marks;
  • returned with original tags and packaging where reasonably possible; and
  • accompanied by proof of purchase.

8.1 Defective or Incorrect Products

If you receive a product that is defective, damaged, materially different from the product ordered, or otherwise does not comply with applicable consumer rights, please contact us as soon as reasonably possible.

We will assess the issue and provide the appropriate remedy required by applicable law, which may include repair, replacement or refund, depending on the circumstances.

8.2 Change-of-Mind Returns

Where a change-of-mind return is permitted by applicable law or by our stated returns policy, any applicable conditions, time periods and return costs will be communicated to the customer.

Nothing in this section limits a consumer's statutory rights.

8.3 Sale and Promotional Items

Sale or promotional items may be subject to specific conditions disclosed at the time of purchase.

However, a sale or promotional price does not remove any statutory consumer rights relating to defective, unsafe or incorrectly supplied goods.

9. Cancellations

Customers may request cancellation of an order by contacting us as soon as possible.

Cancellation requests are not guaranteed once an order has entered production, dispatch or delivery.

Where a cancellation right applies under South African law, MZ Fashion Designers will honour that right.

For customised or personalised products, cancellation may be subject to the rights and exceptions applicable to those products.

10. Consumer Rights

MZ Fashion Designers respects the rights afforded to consumers under South African law.

These Terms and Conditions are not intended to exclude, restrict or waive any consumer right or remedy that cannot legally be excluded, restricted or waived.

In particular, nothing in these Terms and Conditions is intended to exclude rights provided by the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or any other applicable South African legislation.

11. Promotions and Discounts

From time to time, MZ Fashion Designers may offer promotions, discounts, competitions, vouchers or special offers.

Each promotion may have additional terms and conditions, which will be communicated at the time of the promotion.

Unless otherwise stated:

  • promotions cannot be exchanged for cash;
  • promotions cannot be transferred;
  • promotional codes must be used before their expiry date; and
  • only one promotional code may be used per order.

Nothing in promotional terms limits any rights that consumers have under applicable law.

12. Intellectual Property

All content appearing on the MZ Fashion Designers website, including but not limited to:

  • logos;
  • brand names;
  • photographs;
  • product images;
  • graphics;
  • designs;
  • text;
  • marketing material; and
  • website content

is owned by or licensed to MZ Fashion Designers unless otherwise indicated. You may not reproduce, copy, modify, distribute, sell or commercially exploit our content without our prior written permission, except where permitted by law.

Customers agree not to misuse our website or attempt to:

18. Force Majeure

MZ Fashion Designers will not be responsible for delays or failure to perform its obligations where the delay or failure results from circumstances beyond our reasonable control.

Such circumstances may include natural disasters, severe weather, fire, flood, war, civil unrest, industrial action, government action, interruptions to transport networks, telecommunications failures, power outages, cyber incidents or failures of third-party service providers.

We will take reasonable steps to minimise the effect of such circumstances on customers.

The remaining provisions will continue to apply to the extent permitted by law.
